Whether Trustee’s proposed resolution of objection to exemptions, which was set forth as part of a motion to sell estate property, should be approved where the Trustee was requiring Debtor to turnover cash in lieu of anticipated excess claimed exempt personalty arising from an improvement in the available equity in the subject exempt property?
Ruling:
The Court approved the sale, but directed Debtor to amend her schedules to maximize her allowed personal property exemptions. Debtor and the Trustee could then better calculate any excess exemptions and settle any payment terms.
